Bikebug Colnago C68 Gravel HGGR Bike Giveaway T&Cs – full conditions (Terms and Conditions)

Competition Overview:

The following Terms and Conditions govern the “Bikebug Colnago Giveaway” competition that is being promoted by the Promoter.
Information on how to enter forms part of the Terms and Conditions. Entry into the Bikebug Colnago C68 Gravel HGGR Bike Giveaway (Promotion) is deemed to be an acceptance by the entrant of these Terms and Conditions.
The Promoter is Adventure Online Pty Ltd (ABN 38 650 576 195) trading as Bike Bug of 31 Gravel Pit Road, Darra, Queensland 4076.
The Promotion commences 8:00 AM AEST 8/11/2024 and closes 11:00 PM AEST 13/12/2024 (Promotion Period).
The relevant licenses and permits for this Promotion is as follows:
1. NSW – NTP/11503
2. SA – T24/1930
3. ACT – TP 24/02515

Registration and Eligibility:

Entry is open to residents of Australia of 18 years old or over in all eligible states/territories who fulfil the method of entry requirements.
Employees and the immediate families of the Promoter and organisations or agencies associated with or benefiting from the Promotion are ineligible to enter.
Immediate families means any of the following:
1. spouse;
2. ex-spouse;
3. de-facto spouse;
4. child or stepchild (whether natural or by adoption);
5. parent;
6. stepparent;
7. grandparent;
8. step-grandparent;
9. uncle;
10. aunt;
11. niece;
12. nephew;
13. brother;
14. sister;
15. stepbrother;
16. stepsister; or
17. 1st cousin.
To enter the Promotion, the entrant must:
1. Place an order during the Promotion Period of $149.99 worth of products from only brands: Shimano, Lazer and Pro (meaning only products from these brands will contribute to the $149.99 threshold, other products can be purchased in the order but they will not contribute to the threshold to gain entry to the competition);
  1. each order of an amount equal to or greater than $149.99 (subject to 4.a) will be deemed as 1 entry;
  2. 1 entry per order will automatically be added at the checkout; and
  3. the entrant will only receive 1 entry per order,
2. orders may be placed with the Promoter by either online purchase(s) through bikebug.com or in the showroom located in Darra, Brisbane; and
3. at time of placing its order register a current, valid and ‘opt-in’ email address with the Promoter (Registered Email), along with a current valid Australian phone number (Registered Phone Number).
Multiple orders will entitle the entrant to a corresponding number of entries, subject to the conditions in clause 4 above.
Orders are deemed to be received at the time of receipt by the Promoter.
Orders received outside of the Promotion Period will not be accepted as entries into the Promotion.
Unknown, incomplete, indecipherable orders will be deemed invalid.
Where an order is subsequently cancelled by the entrant and/or a refund and return is processed for that order, the Promoter reserves the right to cancel the entry/s associated with that order.
Records of the Promoter are final and conclusive as to time of receipt and validity of the order and entry to the Promotion.
The Promoter reserves the right to cancel the entry/s associated with any invalid email address or phone numbers.
Records of the Promoter are final and conclusive as to whether an entrant has a Registered Email and Registered Phone Number.
In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered.
Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions.
The Promoter and its associated agencies or companies accept no responsibility for any lost or misdirected entries.
Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be void.
If for any reason the Promotion is interfered with in any way or is not capable of running as planned due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right in its discretion, to the fullest extent permitted by law to:
1. modify suspend, terminate or cancel the Promotion as appropriate, subject to approval of the gaming authorities in each State and Territory where relevant; or
2. disqualify any entrant.

Draw:

One (1) entry will be drawn at random and one (1) winner will be announced at 2:00 PM AEST on the 20/12/2024.
The draw will take place at 31 Gravel Pit Road, Darra, Queensland 4076.
The winner will then be emailed and phoned by 27/12/2024.
The winner is not required to be present during the draw.
The winner for the prize draw will be awarded a complete Colnago C68 Gravel HGGR bike including accessories (spec list below) (Prize).
The total prize pool for the Promotion is RRP of $17,526.34 AUD.
The Prize must be taken as offered, and is not transferable or exchangeable by the winner for cash or any other prize, unless otherwise specified in writing by the Promoter (in their absolute discretion).
Once awarded, the Promoter is not liable for the Prize if it has been lost, stolen, damaged or tampered with in any way.
The winner will be notified by phone within 7 days of the prize draw (and where required will be notified in writing to their advised email and/or delivery address) and their Prize will be issued within 7 days of the Promoter notifying the winner (and verifying validity of their entry).
The winner’s last name, first initial and postcode for each draw will be published on the Promoter’s website at www.bikebug.com within 30 days of the date of the draw.
The winner’s name will also be published in the following newspapers:
1. The Australian
2. ACT – The Canberra Times
3. NT – NT News
The winner may request that their name and postcode not be published.
Subject to the unclaimed prize draw clause, if for any reason a winner does not claim, accept or take delivery of the Prize for any reason within 10 business days from the announcement of the winner then the Prize will be forfeited.
The Promoter may conduct such further draws as are necessary for any unclaimed prizes on 12/01/2025 at the same time and place as the original prize draw, subject however to any directions given by any applicable gaming authorities.
The winner of any unclaimed prize draw will be notified within 7 days of the unclaimed prize draw (in writing), and their last name, first initial and postcode will be published on the Promoter’s website at www.bikebug.com within 30 days of the unclaimed prize draw.
If the Prize (or portion of the Prize) is unavailable the Promoter reserves the right to substitute the Prize (or that portion of the Prize) to a prize of equal or greater value and specification, subject to any written directions of a regulatory authority.
In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.

Other Conditions:

The Promoter accepts no responsibility for any tax liability incurred as a result of entering and participating in the Promotion and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
Any tax liability arising as a result of accepting any Prize is the responsibility of the winner.
Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Entrants consent (except to the extent that the entrant may otherwise notify to the Promoter) to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for a period of up to 24 months from the date that the winner is announced, without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information (including email addresses) in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities.
The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.bikebug.com/privacy-policy/.
Entry is conditional on providing this information.
By entering the Promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and, in addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may use this information in any media for future promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant, without any further reference or payment or other compensation to the entrant.
All personal details of the entrants will be stored at the office of the Promoter.
A request to access, update, opt out or correct any information should be directed to that office. Any complaints regarding the treatment of personal information should also be directed to that office and will be dealt with by the Promoter in accordance with its Privacy Policy.
All entries become the property of the Promoter.
Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
The Promotion and the terms in the condition of entry will be governed by Australian Law and any disputes will be subject to the exclusive jurisdiction of the courts of the respective states and territories in which the claim is made.
This Promotion is in no way sponsored, endorsed or administered by, or associated with any social network.
The Provider reserves the right to cancel or amend these Terms and Conditions without prior notice, subject to any notice that must be provided to a regulatory authority.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
By entering into this competition, an entrant is indicating his/her agreement to be bound by these Terms and Conditions.

Terms & Conditions of entry

Information on how to enter and prize details form part of these terms & conditions (Terms of entry). The Terms must be read in conjunction with the Schedule. The Schedule defines the terminology used in these Terms of entry. Where there is any inconsistency between these Terms and the Schedule, the Schedule prevails. Participation in this Promotion is deemed acceptance of these Terms of entry.
Entry is open only to legal residents of the Eligible States/Territories who satisfy the Method of entry. Directors, officers, management, employees, suppliers (including prize suppliers) and contractors (and the immediate families of directors, officers, management, employees, suppliers and contractors) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Promotion, including the competition permit providers TPAL (Trade Promotions and Lotteries Pty Ltd) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
The Promotion will be conducted during the Promotion period.
The time zone applicable to any time stated, relates to the state or territory where the Promoter is located, unless expressly stated to the contrary.
The Prize/s are specified in the Details of prizes section of the Schedule.
The total prize pool is specified in the Total prize value section of the Schedule.
Any prize is valued in Australian dollars unless expressly stated to the contrary.
Entrants are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Entrants are responsible for any and all expenses that they incur in entering the competition and they will not be reimbursed regardless of whether or not they win the competition.
The entrants must follow the Method of entry during the Promotion period to enter the Promotion. Failure to do so will result in an invalid entry. The Promoter will not advise an Entrant if their entry is deemed invalid.
The time of entry will be deemed to be the time the entry is received by the Promoter.
Entrants may submit up to the Maximum number of entries (if applicable).
The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected entries, claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
The prize(s) will be awarded to the valid entrant(s) drawn randomly in accordance with the Prize draw details. If a draw is scheduled on a public holiday, the promoter may choose to instead hold the draw on the first business day after the relevant public holiday. The Promoter may draw additional reserve entries (and record them in order). In the event of an invalid entry or an ineligible entrant, or if the entrant is ineligible to accept the prize, the prize will be awarded to the first reserve entry drawn. If the prize can’t be awarded to the entrant drawn, the promoter will then continue this process until the prize is awarded.
The winner does not need to be present at the draw unless expressly stated to the contrary.
The winner(s) will be notified in accordance with the Notification of winners and Notification of unclaimed prize winners (if applicable) sections of the Schedule. Notification to winners will be deemed to have occurred on the later of the time the winner receives actual notification from the Promoter or two business days thereafter. The notification will include details about how the prize(s) can be claimed.
The Promoter takes no responsibility where it is unable to contact prize winners who have not provided correct or complete contact details. If an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to modify any entry information should be directed to the Promoter.
It is a condition of accepting any prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The winner(s) name and state/territory of residence will be published in accordance with the Public announcement of winners section of the Schedule (if applicable).
If the prize(s) has not been claimed by the Unclaimed prize draw time and date and subject to any written directions from a State lottery agency, the Promoter may conduct an Unclaimed prize draw in accordance with the Unclaimed prize draw section of the Schedule (if applicable). In the event the Unclaimed prize draw takes place, the Promoter will attempt to contact the winner(s) of the Unclaimed prize draw in accordance with the Notification of unclaimed prize draw section of the Schedule, and if applicable, the name and State/Territory of residency of any winner(s) of the Unclaimed prize draw will be published in accordance with the section of the Schedule entitled Public announcement of winners from unclaimed prize draw. If a prize is no longer available the promoter may substitute with a prize of higher or equal value subject to any written directions from a regulatory authority. The promoter is not allowed to deduct any administrative costs associated with provision of the prize.
To the greatest extent permitted by law, the Promoter excludes all warranties, representations or guarantees (Warranties) regarding the Promotion and any prizes, including any Warranties which may have been made in the course of advertising or promoting the Promotion. The conduct of the Promotion or the supply of prizes may involve third parties, and the Promoter makes no Warranties and disclaims all liability in connection with any such third parties, their acts or omissions. By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees and agents of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
If despite the foregoing clause, the Promoter incurs a liability to an entrant under any law which implies a Warranty into these Terms of entry which cannot legally be excluded, the Promoter’s liability in respect of the Promotion is limited, in the Promoter’s discretion, to either resupplying such goods or services as form part of the Promotion, or paying the cost of resupplying those goods or services.
Without limiting any of the foregoing, in no circumstances will an entrant or the Promoter have any liability to the other for any loss or damage suffered which is indirect or consequential in nature, including without limitation any loss of profit, loss of reputation, loss of goodwill, or loss of business opportunity.
The Promoter and its associated agencies and companies will not be liable for any delay, damage, or loss in transit of prizes.
The Promoter may in its absolute discretion not accept a particular entry, may disqualify an entry, or cancel the entire Promotion at any time without giving reasons and without liability to any entrants, subject to any written directions from a regulatory authority. Without limiting this the Promoter reserves the right to verify the validity of entries, prize claims and entrants and to disqualify any entrant who submits an entry or prize claim that is misleading or not in accordance with these Terms of entry or who manipulates or tampers with the entry process. In the event that a winner breaches these Terms of entry, the winner will forfeit the prize in whole and no substitute will be offered. Verification is at the discretion of the Promoter, whose decision is final. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, subject to any written directions from a regulatory authority. Where a prize is unavailable for any reason, the Promoter may substitute the prize for another item of equal or higher value subject to any written directions from a regulatory authority. The Promoter accepts no responsibility for any variation in prize value (including between advertising of the Promotion and receipt of the prize).
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability (or that of a third party involved with the Promotion) to proceed with the Promotion on the dates and in the manner described in these Terms of entry, including but not limited to vandalism, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter’s obligations in respect of the Promotion will be suspended for the duration of the event and, in addition, the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to approval of the relevant authorities.
All entries become the property of the Promoter. As a condition of entering into this Promotion, entrants agree to assign all their rights in and to their entry and any related content to the Promoter, including any copyright or other intellectual property rights in the entry and related content. Without limiting this, the Promoter may use entry content for any and all purposes including commercial purposes. You warrant that entry content is original, lawful and not misleading and that the Promoter’s use of such content will not infringe the rights of any third parties. The Promoter has no obligation to credit you as the author of any content submitted and may otherwise do any acts or omissions which would otherwise constitute an infringement of any moral rights you may have as an author of content.
Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter including third parties may, for an indefinite period, unless otherwise advised, use the private information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
The collection and disclosure of personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy statement which adheres to the Privacy Act 1988 (cth) and Australian Privacy Principles.
The Promotion and these Terms of entry will be governed by the law of the State or Territory in which the Promoter ordinarily resides. Entrants accept the non-exclusive jurisdiction of courts and tribunals of that State or Territory in connection with disputes concerning the Promotion.
Facebook, YouTube, Instagram, TikTok, or Snapchat may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, YouTube, Instagram, TikTok or Snapchat; and to release Facebook, YouTube, Instagram, TikTok, or Snapchat from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and not Facebook, YouTube, Instagram, TikTok, or Snapchat.

$200 voucher signup competition

1. Eligibility:

This competition is open to individuals aged 18 years or older.
Employees of the promoter and their immediate families are not eligible to enter.

2. How to Enter:

To enter, participants must sign up for our mailing list via the sign-up form on our website.
Only one entry per person is allowed.

3. Competition Period:

The competition is ongoing with monthly draws. Each draw takes place on the first Tuesday of every month.

4. Prize:

Each month, one winner will receive a $200 voucher.
The prize is non-transferable and cannot be redeemed for cash.

5. Winner Selection and Notification:

Winners will be drawn randomly on the first Tuesday of each month.
The winner will be notified via the email address provided at the time of sign-up.
To be eligible to win, participants must remain subscribed to our mailing list at the time of the draw.

6. Privacy:

By entering the competition, participants consent to the use of their email address for communication purposes related to this competition and other updates from the promoter.
Participants' information will be handled in accordance with our privacy policy.

7. General Conditions:

The promoter reserves the right to amend, suspend, or cancel the competition at any time without prior notice.
The promoter’s decision in all matters relating to the competition is final, and no correspondence will be entered into.
